1. Acceptance of Terms

By accessing or using ChalkSurf ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. We may update these Terms from time to time; continued use after changes constitutes acceptance of the updated Terms.

2. Description of Service

ChalkSurf is an AI-powered platform for math teachers to discover, create, organize, and customize math exercises and teaching materials. The Service includes features such as exercise search, AI-assisted exercise extraction from uploaded documents, exercise generation and adaptation, worksheet assembly, and a shared exercise library.

3. Accounts

You must create an account to use the Service. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must provide accurate information when creating your account and promptly update it if it changes. We reserve the right to suspend or terminate accounts that violate these Terms.

If you create API tokens, authorize OAuth or MCP access, or connect external tools to your account, you are responsible for keeping those credentials secure and revoking access when it is no longer needed.

4. Your Content

Ownership

You retain ownership of all content you create, upload, or submit to the Service ("Your Content"), including exercises, solutions, hints, figures, and worksheets. By using the Service, you grant us a limited license to store, process, display, and transmit Your Content as necessary to operate the Service.

Public Content

When you mark content as "Public," you grant other ChalkSurf users a non-exclusive license to view, use, and incorporate that content into their own teaching materials within the Service. You may change content back to "Private" at any time, but copies already incorporated into other users' worksheets may remain available to those users. If your account is deleted, public or shared content may remain in anonymized form where other users or organizations are entitled to keep using it.

Responsibility

You are solely responsible for Your Content. You represent that you have the right to upload and share any content you submit, and that Your Content does not infringe any third party's intellectual property rights. You must not upload content that is illegal, harmful, or violates the rights of others.

ChalkSurf is designed for teachers and educators. Unless you have the required rights, authority, and legal basis, you must not upload student personal data, student names, or identifiable student work to the Service.

5. AI Features

The Service uses third-party large language model (LLM) APIs to provide AI-powered features such as exercise extraction, generation, and adaptation. You acknowledge that:

  • AI-generated content may contain errors, inaccuracies, or unexpected results. You are responsible for reviewing and verifying all AI-generated output before using it in a teaching context.
  • Your input content is sent to third-party LLM providers for processing. We send only the content necessary for the requested operation.
  • AI features are provided on an "as available" basis and may change, degrade, or become unavailable due to changes in third-party APIs.

6. Optional Integrations and Delegated Access

The Service may let you connect optional integrations, such as Google Drive imports, CLI tools, MCP clients, or other delegated-access workflows. You are responsible for authorizing only integrations you trust and for checking the permissions you grant. You can revoke supported delegated access from the Service where the relevant management controls are available, or by contacting us.

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to the Service, other accounts, or our systems
  • Interfere with or disrupt the Service or its infrastructure
  • Scrape, crawl, or use automated tools to extract content from the Service in bulk
  • Upload malicious files, viruses, or harmful code
  • Misrepresent your identity or impersonate others
  • Upload student personal data unless you have the required authority and legal basis
  • Use the Service to generate content that is illegal, harmful, or infringes on others' rights
  • Resell or redistribute the Service without our written permission

We reserve the right to suspend or terminate your access if you violate these Terms.

8. Intellectual Property

The Service itself - including its design, code, branding, and documentation - is owned by ChalkSurf and protected by applicable intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or other brand features.

The shared exercise library contains content contributed by users. Individual exercises and materials remain the intellectual property of their respective creators, subject to the public content license described in Section 4.

9. Availability and Modifications

We strive to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will make reasonable efforts to notify you of significant changes that affect your stored content.

10. Payment and Subscriptions

If the Service offers paid plans or features in the future, the applicable pricing and billing terms will be communicated to you before any charges are incurred. Free-tier features and limits may change over time.

11. Limitation of Liability

To the maximum extent permitted by applicable law, ChalkSurf and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. This includes, without limitation, damages for loss of data, loss of profits, or interruption of service.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that AI-generated content is accurate, complete, or suitable for any particular educational purpose. You use AI-generated materials at your own discretion and risk.

13. Indemnification

You agree to indemnify and hold harmless ChalkSurf and its operators from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third party's rights.

14. Termination

You may request account deletion by contacting us. Upon account deletion, your private content will be removed or anonymized within 30 days, subject to the provisions in our Privacy Policy regarding legal retention, security records, backups, and public or shared content.

We may suspend or terminate your account at any time for violation of these Terms, with or without prior notice. Upon termination, your right to use the Service ceases immediately.

15. Governing Law and Disputes

These Terms are governed by the laws of Hungary. Any disputes arising from these Terms or the Service shall be resolved in the courts of Hungary, unless mandatory consumer protection laws in your jurisdiction provide otherwise.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
